セクシュアル・ハラスメントを含む性暴力等の防止について （声明）

セクシュアル・ハラスメントを含む性暴力等は、被害者の尊厳を著しく踏みにじる行為であり、被害者の生涯に渡って回復し難い心理的外傷や心身に対する重大な影響を与えます。これは、断じて許されるものではありません。特に、教育機関である大学において、セクシュアル・ハラスメントを含む性暴力等が生じることはあってはなりません。
政府においても、令和５年６月の刑法及び刑事訴訟法の改正において不同意性交等罪・不同意わいせつ罪への改正がされたほか、性的姿態の撮影行為及びその画像等の提供行為に係る罪の新設等がなされ、また、関係府省会議においても「性犯罪・性暴力対策の更なる強化の方針」を令和５年3月に策定し、令和5年度から7年度を「更なる集中強化期間」に位置付けるなど、継続的に性犯罪・性暴力対策の強化を進めています。これを受けて、文部科学省は、令和５年9月29日付け「セクシュアルハラスメントを含む性暴力等の防止に向けた取組の更なる推進について（通知）」等を発出し、各大学に対し、学内規則の見直しや行為者への厳正な対処等のセクシュアル・ハラスメントを含む性暴力等の防止に一層積極的に取り組むこと等を要請しています。
わいせつ行為や盗撮などの性犯罪・性暴力への厳正な対処や被害防止の徹底に対する社会的要請が一層強まっている動向を踏まえ、東海国立大学機構では、改めて、セクシュアル・ハラスメントを含む性暴力等の防止に積極的に取り組み、セクシュアル・ハラスメントを含む性暴力等を決して見逃さず、許さないという姿勢を示し、以下のような取り組みを一層進めて参ります。
- 教職員又は学生がセクシュアル・ハラスメントを含む性暴力等の行為を行った場合は、厳正に処分する。
- 教員・職員の採用時にセクシュアル・ハラスメントを含む性暴力等を原因とする懲戒処分歴等の確認等を行う。
- セクシュアル・ハラスメントを含む性暴力等の行為者に対する懲戒処分について、機構及び各大学の規則に基づいて適切に公表する。
- 積極的に警察や医療機関、支援センター等の外部関係機関等との連携を図る。
- 相談体制の充実を図る。
Preventing Sexual Violence, Including Sexual Harassment, at the Tokai National Higher Education and Research System(Statement)

Sexual violence, including sexual harassment, is an act that seriously violates the dignity of the victim, and it creates irreversible psychological trauma and profound effects, both mental and physical, that last the victim's entire life. This is absolutely unacceptable. As educational institutions, universities in particular must be free from sexual violence, including sexual harassment.
In the June 2023 amendments to the Penal Code and the Code of Criminal Procedure, in addition to revisions regarding non-consensual sexual intercourse and non-consensual indecency, the government also created new offenses regarding photographing sexual parts and sex acts without a justifiable reason or consent and sharing such images, etc. In addition, in the March 2023 meeting of related ministries and agencies, the “Policy for Further Strengthening Measures Against Sex Crimes and Sexual Violence” was formulated, and measures against sex crimes and sexual violence are being continually strengthened, with steps including declaring the period from 2023 to 2025 to be a “further intensive strengthening period”. Following this, the Ministry of Education, Culture, Sports, Science and Technology issued a notice to universities dated September 29, 2023 titled “Further Promoting Efforts to Prevent Sexual Violence, Including Sexual Harassment (Notice)” and requested that universities take more proactive steps to prevent sexual violence, including sexual harassment, by reviewing campus rules and taking strict action against perpetrators.
In light of the growing social demand for strict measures to punish and prevent sex crimes and sexual violence such as indecent acts and voyeur videos, we at the Tokai National Higher Education and Research System (THERS) have renewed our resolve to take proactive steps to prevent sexual violence, including sexual harassment; to demonstrate our stance that we will neither overlook nor tolerate sexual violence, including sexual harassment; and to further advance the following initiatives:
- We will take strict disciplinary action against a faculty or staff member or a student who commits an act of sexual violence, including sexual harassment.
- When hiring faculty and staff members, we will check their history of disciplinary actions resulting from sexual violence, including sexual harassment.
- We will appropriately announce disciplinary actions taken against perpetrators of sexual violence, including sexual harassment, based on THERS and university rules.
- We will proactively work with external organizations such as the police, medical institutions, and support centers.
- We will improve and enhance our consultation system.
